When I first started day trading $SPY on Webull, I tried to buy an option contract with same-day expiration but I got denied. Webull denied me because it does not allow their users to open a new position with same-day expiration after 2PM Easter Time.
I later learned that every trading platform is different with opening up new same-day expiration $SPY positions. But all of them allow you to close your position by 4:15PM Eastern Time.
Also, all brokerages allow you to open new none same-day expiration $SPY positions until 4:15PM Eastern Time.

After talking to Fidelity over the phone, it seems that they will only allow it to clients that have a net worth of $1 million. If you do not have a net worth of $1 million, then you’re not eligible.
